PRIVACY STATEMENT
Viela Bio (“we”, “us”, or “our”) is committed to respecting your privacy. This privacy statement (the “Privacy Statement”) explains our practices regarding the collection, use and disclosure of information that you may provide to us through your use of www.vielabio.com (“Site”). This Privacy Statement describes the types of information we gather from people visiting and interacting with our Site (“you” or “users”), and how we use, transfer, and secure such information. This Privacy Statement does not cover other services that we may offer or provide, and does not cover information we receive from third parties. For example, our use of information collected in connection with our clinical studies, product quality complaints and adverse event reports is governed by separate privacy notices.

This Privacy Statement is incorporated into, and is part of, our Terms of Use which govern your access to the Site and your use of the Site, unless you have entered into a separate written agreement with us. If you have entered into a separate written agreement with us, that separate written agreement shall control, and only those terms within this Privacy Statement that do not conflict with such separate written agreement shall apply. Information We Collect and How We Use It
We collect two types of information from users and visitors of our Site: “Personal Information,” which is information that you provide that can be used to identify you (such as name, email address, etc.), and “Aggregate Information,” which is information that cannot be used to identify you (such as data about what parts of our Site are most or least frequently viewed, changes in the volume of traffic to our Site over time, etc.)

Personal Information Collected
We collect Personal Information that you voluntarily provide to us when you use our Site. For example, you may provide us with your email address, first name and last name, phone number, or other Personal Information when you choose to submit such information to us through email, an online form or other method (such as contacting us through our “Contact Us” or “Careers” Site features).

If we have collected your Personal Information through our Site, we may use it to inform you about our products and services and to gather feedback from you on our Site and services. You may unsubscribe from any marketing communications at any time by selecting the opt-out link which will be contained in any such email or communications that you receive, or by contacting us by using the details below.

Employment
If we have collected your Personal Information through our “Careers” page in response to a job opening, you are giving us permission to process and retain your information for the purpose of evaluating your application for employment consideration for the specific position that you applied to, as well as other roles at Viela Bio. This Personal Information may be processed and stored by a third party talent tracking solution provider.

Collection of Personal Information by Third Parties
Some links on our Site may redirect you to third party websites that we do not operate. The privacy practices of those websites will be governed by their own policies. We make no representation or warranty as to the privacy practices or policies of any third parties, including the providers of third party applications. If you are submitting information to any such third party through our Site, you should review and understand that party’s applicable policies, including their privacy policies, before providing your information to the third party.

Aggregate Information Collected
Aggregate Information is information that does not identify you. Aggregate Information may be collected when you visit our Site, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Aggregate Information remains. We may collect, use, store, and transfer Aggregate Information without restriction.

For example, when you visit our Site, some information is automatically collected. Such information could include your operating system, the site from which you linked to us (“referring page”), the name of the website you choose to visit immediately after ours (called the “exit page”), information about other websites you have recently visited, browser (software used to browse the internet) type and language, device identifier numbers, your site activity, and the time and date of your visit. Google Analytics does not create individual profiles of visitors and only collects Aggregate Information. Corrections/Information Removal/Opt-Out
You can request that any Personal Information stored by us be deleted at any time by contacting us at info@vielabio.com. We may require you to provide certain information to verify that it is you making the request. However, note we will not delete information that we are required to retain in order to comply with applicable laws and regulations.

If you no longer wish to receive our marketing and promotional communications, you may opt-out by following the instructions included in each communication.

Children and Privacy
Our Site is not intended to be used by children under the age of 16, and we do not knowingly collect Personal Information from children under the age of 16 in connection with the Site.

How Do We Protect Your Information
We take the security of your Personal Information very seriously. We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us. This notice applies to information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household such as your real name, alias, postal address, unique personal identifier, online identifier Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers (“personal information”).  Personal information does not include publicly-available information and certain other information that is regulated by other applicable laws.

Right to Know

You have the right to request that we disclose certain information to you about our collection of your personal information.  Such information shall cover the 12-month period preceding our receipt of your request. Upon our receipt of your verified request, we will provide you with the following:

  • The categories of personal information we have collected about you
  • The categories of sources from which we have collected your personal information
  • Our business or commercial purpose(s) for collecting or selling your personal information
  • The categories of third parties with whom we have shared your personal information; and
  • The specific pieces of personal information we have collected about you

You have the right to request that we disclose certain information to you about our disclosures and sales of your personal information.  Such information shall cover the 12-month period preceding our receipt of your request. Upon our receipt of your verified request, we will provide you with the following:

  • The categories of personal information we have collected from you
  • The categories of personal information we have sold about you and the categories of third parties to whom we sold such information, by category or categories of personal information for each category of third parties to whom the personal information was sold; and
  • The categories of personal information that we disclosed about you for a business purpose

Right to Opt-Out

We do not sell your personal information now and have no plans to start, however, we are required to let you know that you have the right to opt-out of the sale of your personal information at any time if we ever engage in such activity.

Right to Delete

You have the right at any time to request that we delete your personal information.  However, in some cases we cannot delete all or some of your personal information as required or permitted by applicable laws.

Right to Non-Discrimination

We will not discriminate against you for exercising your rights under the CCPA, such as denying you products and services, charging you different rates or prices including use of discounts or penalties, or suggesting or providing a different service level to you.  However, we may charge a different price or provide a different service level only if the price or difference is directly related to the value provided to you by your personal information.

How to Contact us to Exercise Your Rights

To submit a request to exercise your “Right to Know” or “Right to Delete” rights provided in this notice, please email us at be info@vielabio.com. We will evaluate the request and take action where required to do so.

We will confirm receipt of your request within 10 business days and will provide information about how we will process your request. We endeavor to respond to your request as soon as we can, within the timeframes permitted under the CCPA. If we are not able to respond to your request within 45 days, we will let you know that we may require additional time (up to 90 total days).

Verification of Requests and Authorized Agents

We may have to verify your identity when you contact us to exercise your “Right to Know” or your “Right to Delete.”  Our verification process may vary depending on the nature of your request..  However, generally, we will verify your request by asking you to:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized agent.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you.

You may also use an authorized agent to exercise your rights on your behalf. If you wish to use an authorized agent to make a request on your behalf, unless you have provided the authorized agent with power of attorney, we may require that: (1) you provide your authorized agent signed permission to do so; (2) you verify your identity; and (3) you confirm that you have provided the authorized agent permission to submit the request. We may deny any request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf

Please note that in most cases we are not able to respond to more than two “Right to Know” requests from a consumer in any 12-month period.

We have collected the following categories of personal information from consumers in the last twelve (12) months:

  • Commercial information (such as products or services you considered, or other purchasing or consuming information)
  • Internet or other electronic network activity (such as your browser type, frequency and time and date of visits to our Site, operating system, the site from which you linked to us, the name of the website you chose to visit immediately after ours, information about other websites you have recently visited, and site activity)
  • Geolocation data (such as your approximate location based on IP address)
  • Employment History (such as your professional or employment-related information)
  • Inferences from the above information (we may draw inferences drawn from any of the information identified above to create profiles of users and those that interact with us)

Our sources for this information:

  • We collect Personal Information that you voluntarily provide to us when you use our Site or interact with us. For example, you may provide us with your email address, first name and last name, phone number, or other Personal Information when you choose to submit such information to us through email, an online form or other method, or you may be a healthcare professional that we interact with.
  • Some information is automatically collected when you visit our Site or use our mobile applications.
  • We also collect information offline, as well as with information provided to us by third parties. Such third parties may third party vendors, health care professional and health insurance companies, partners, and public sources.

Our business purposes for collecting this information:

We generally use Personal Information for the purposes for which we collect it. If we have collected your Personal Information through our Site or through our interaction with you, we may use it to inform you about our products and services and to gather feedback from you on our Site and services, and our business overall.  We may also use this information to respond to your requests, inform you about our company and events, and to send you advertisements.  It also helps us to improve our business, our Site user experience, authenticate you, perform analytics, better understand how users and third parties interact with us, prevent and detect fraud and potential security issues, and to fulfill our legal and regulatory obligations.

• improving our website content and functionality.

Information regarding the transfers of personal data outside of the European Economic Area (EEA)
–Viela is based in the USA and that’s where we process the personal data of users of our Site. When you provide personal data to us, we request your consent to transfer that Personal Information to the USA. The USA does not have an adequacy decision from the European Commission, which means that the Commission has not determined that the laws of the USA provide adequate protection for personal data. Although the laws of the USA do not provide legal protection that is equivalent to EU data protection laws, we nonetheless treat the personal data of EEA users in accordance with this Privacy Statement. We take appropriate steps to protect your privacy and implement reasonable security measures to protect your personal data in storage. We also enter into contracts with our data processors that require them to treat personal data in a manner that is consistent with this Privacy Statement.

The period for which the personal data will be stored
–We retain personal data so long as it is necessary for the purpose for which it was collected and delete personal data after it is no longer needed for these purposes. This does not affect your right to request that we delete your personal data before the end of its retention period. We may archive personal data (which means storing it in inactive files) for a certain period of time prior to its final deletion, as part of our ordinary business continuity procedures.

Your rights to access, correct, restrict, or delete your personal data and object to processing

access to your personal data, to have it corrected if the personal data we have is incorrect, to request that we restrict or delete your personal data, and to object to our processing of your personal data.
